1. Acceptance of Terms

Welcome to Bedding Industries of America, LLC (referred to as "us," "we," "our," or "Glacier Sleep" as the context may require) website (the “Website”). These terms and conditions (the "Terms") apply to the purchase and sale of products and services through glaciersleep.com and/or any affiliated blogs or websites operated by Bedding Industries of America, LLC (collectively the "Company" or "Glacier Sleep").

By accessing or using this site in any way, and/or purchasing products from this site, you agree to be bound by these Terms and Conditions ("Terms" or the "Agreement") as well as our Privacy Policy and our Trial, Warranty, and Return policies (collectively, the "Policies"). This Agreement governs your relationship with Glacier Sleep for any purchase or other transactions made through our sites.

These Terms are subject to change by Bedding Industries of America, LLC without prior notice, and changes take effect from the last updated date listed on the site. You should review these Terms before purchasing any product. Your continued use of the site after changes constitutes your acceptance of and agreement to any modifications.

Please review this Agreement and the other policies listed carefully. THIS DOCUMENT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS, OBLIGATIONS, AND CONDITIONS. PLEASE READ IT CAREFULLY. These terms include the use of arbitration for resolving disputes instead of jury trials or class actions. By placing an order, you certify that you have read, understood, and agree to these Terms. If you place an order on behalf of an organization or company, you certify that you have the legal authority to bind the organization or company to these terms. You may not order or obtain products or services from this website if you (a) do not agree to these terms, (b) are not at least 18 years of age, or (c) are prohibited from accessing or using this site by applicable laws.

1. Order Acceptance and Cancellation

You agree that your order is an offer to purchase, under these Terms, all products listed in your order. All orders must be accepted by us or we will not be obligated to sell the products to you. We reserve the right to decline orders at our sole discretion, even after sending you an order confirmation email.

1. Price and Payment Terms

(a) Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as listed in your order confirmation. Price increases only apply to orders placed after the change. Posted prices do not include taxes, shipping, or handling fees unless otherwise indicated. These charges will be added during the checkout process and itemized in your order confirmation.

(b) Promotional pricing may be available from time to time, governed by separate terms. If a conflict arises between promotional terms and these Terms, the promotional terms will govern.

(c) Payment must be received before we process your order. We accept major credit cards (Visa, MasterCard, American Express, Discover), PayPal, Google Pay, and buy-now-pay-later services (BNPL) such as Affirm. You certify that (i) the billing information provided is accurate, (ii) you are authorized to use the payment method, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges incurred, including taxes and shipping fees.

1. Shipments, Delivery, Title, and Risk of Loss

(a) We will arrange for product shipment to you. Delivery options will be displayed during the ordering process. Shipping charges are your responsibility and cover processing, packing, and shipping of your order.

(b) Shipping and delivery dates are estimates and cannot be guaranteed. We are not liable for delays in shipments.

1. Returns and Refunds

If you are not completely satisfied with your Glacier Sleep purchase during your 365-night trial, contact us at 1-877-908-7523 or email info@glaciersleep.com. We will arrange a return and issue a full refund to your original method of payment. For defective returns, please refer to the product’s manufacturer warranty (see section 6).

THIS SITE MAY CONTAIN ERRORS OR OMISSIONS, AND CONTENT MAY CHANGE WITHOUT NOTICE. GLACIER SLEEP DOES NOT COMMIT TO UPDATING CONTENT IN A TIMELY MANNER.

1. Limitation of Liability

GLACIER SLEEP IS NOT LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY BREACH OF THESE TERMS. YOUR SOLE REMEDY IS LIMITED TO THE AMOUNT PAID FOR THE PRODUCT(S) YOU PURCHASED.

This limitation applies only to the extent allowed by law.

1. Goods Not for Resale or Export

You certify that you are purchasing products for personal use, not for resale or export, and that your purchase is for final delivery to a US location.

1. Privacy

We are committed to protecting your privacy. Our Privacy Policy governs the collection and use of your personal data in connection with your purchase.

1. Force Majeure

We are not responsible for delays or failure to fulfill obligations caused by circumstances beyond our control, including natural disasters, governmental actions, or labor disputes.

You and Glacier Sleep agree to resolve any disputes through binding arbitration in New York County, New York, under the AAA Consumer Arbitration Rules. You waive the right to litigate claims in court or participate in class actions.

You may not assign any rights or obligations under these Terms without our consent.

1. No Waivers

Our failure to enforce any provision of these Terms does not constitute a waiver.

1. No Third-Party Beneficiaries

These Terms do not confer any rights on third parties.

We may provide notices via email or posting on the site. It is your responsibility to keep your contact information up to date.

1. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.

1. Entire Agreement
